I think that the fact that the main prosecution witness fucked up and revealed the discussion between the judge and prosecution on prepping the main prosecution witness made the judge feel that he was more interested in keeping his seat on the bench than trying to ram this shredded case through. I'm fucking delighted!!

Definitely a whoo hoo. A small victory but it's heartening news. The strange thing is either the judge or the prosecutor is lying and it appears the case was dismissed on what seems more like a technicality than a test of what is permissable.

At least the strain of a long trial is no longer hanging over Stagliano. Poor bastard may have HIV but he's not going to lay down and die.

Apparently there was a very tense scene in court where the judge demanded that the prosecuting attorney submit a written statement that the judge had NOT told her to tell the witness anything about their testimony. She said, "I can't do that." He then threatended to force her onto the witness stand and make her recuse herself from the rest of the trial. Only then did she submit the written statement.

So he's off the hook. She rested her case looking completely shaken up and he got on his high horse about how woefully unprepared the prosecution was, ripped them up one side and down the other as he started throwing out one charge after another. So now he looks like some great defender of the constitution and the prosecutor's career is toast.

Gets more and more strange. Opens up a lot of questions about what goes on behind the scenes. Why did she say "I can't do that" - is that because the judge is lying? It appears that she said she couldn't because it was not the "complete truth." So the judge maybe suggested rather than ordered. If that is the case, it questions the integrity and honesty of the judge. Have a feeling the story is going to continue outside the court. Really strange stuff. Delighted that Stagliano gets off, but what on earth went down here? What was so wrong with reviewing the material that was supposed to be obscene?

Okay we all know that judges and prosecutors make Al Capone look like upstanding citizens, but ususally they are competent enough to keep their criminal behaviour and corruption behind closed doors. Edited on Jul 17, 2010, 05:40am

I hadn't gotten this bit before about how thoroughly the prosecution failed to show ANY connection between Stagliano and the DVD's that the FBI Agent got - the label could only be connected to a corporation that, though charged in the indictment, hasn't been active for years -

Interestingly enough, an article a couple of days ago at AVN mentioned - 3rd hand - that one reporter had gotten a chance to speak to a handful of the jurors as they were heading out of the courthouse. None of them would have voted to convict, they told the reporter.

I remember something similar from way back in the 1960/70th here in little ol' Denmark before/when we made porn free...!!

Thanks for the congrats, Denner, but I'm doubt the battle is going to end anytime soon. It may at least stagnate under the Obama administration--generally Democrats are fairly neutral on porn and sex issues--but eventually we'll 'elect' another Jesus freak and the whole three ring circus concerning social issues will raise the tent of idiocy and immaturity once again. Maybe Stagliano will be retired by then and he'll only have to worry about Social Security ending.

Am I right that when Denmark legalized porn they made it pretty universal, except for underage and some bestiality content, or am I wrong? At least you don't have that stupid Miller test to deal with--suddenly everyone is part of a community when it comes to judging porn!

I've been wondering this myself, especially with this recent case. I wonder if they (porn makers) started adding the countless violent acts and the rivers of blood seen in mainstream films to the sex and nudity already in porn it would then be considered obscene?
