While it is entirely possible that content on C4S may not be legal sold, it is difficult to realize who has that right. You have to consider that it may a Bangbros rep posting them or a third-party who has purchased the rights to the videos. It is really up to Bangbros or any other provider to keep track of that and, if necessary, file a copyright violation claim against a store owner. I am sure C4S has some kind of process for handling DMCA/copyright claims.
The most they can do in the short term is ask the store owner to remove any videos that were not sold legally or ban the user if they do not remove them after a short time. The only way a company can sue is if both the store owner and C4S does not reply or remove the clips within a certain period of time. Even still, considering it is the porn industry they usually do not sue since many courts still have a bias against the material they sell and many of them know that at least some level of stolen/distributed content actually brings in more customers.

You make a good point but I can't help but think it's someone who bought a couple memberships and is trying to make a few easy bucks
My concern is those videos have an upload date from a year ago and no one has done anything about it. If Clips 4 Sale only offers the "a posteriori" copyright control you suggest, I can't help but doubt they are doing much in terms of enforcing other legal aspects like model releases and so on.
