A complaint filed in Los Angeles Superior Court is asking that Loeb be compelled to abide by the agreement that the former couple entered into with ART Reproductive Center, which according to the complaint “states that any parties’ disposition of the Pre-Embryos, including their implantation into a surrogate, requires the explicit written consent of the other party.” Loeb, who was involved with Vergara from 2010 until 2014, filed an action against the actress in August 2014 attempting to obtain full custody of the embryos and bring them to term, Vergara’s filing Tuesday noted. Loeb filed to voluntarily dismiss his suit without prejudice — meaning he could re-file again — in December 2016. Since then, Vergara’s filing Tuesday said, Loeb set up a trust for the embryos in Louisiana, “so he will be able to assign legal rights to the Pre-Embroys and thereby cause to bring them to term” without Vergara’s consent. In addition to asking that Loeb be held to his agreement with Vergara, the suit — which alleges breach of contract, promissory fraud and other counts — is seeking unspecified damages.
