The Death of the Cross Sale? Probably Not. Came across an article talking about how Visa was starting to crack down on businesses that share customer credit card with third parties without the customer's consent. Visa has imposed a new rule prohibiting this practice which cost consumers over $1 billion last year and it results in a lot of time and hassle for the credit card companies to deal with customer complaints. It appears this rule would have the effect of banning prechecked cross sales upon signing up for a website without providing follow up emails and consent disclosures. The problem with this rule is that Visa is only applying the rule to transactions involving different merchant account numbers -- meaning that you sign up for a site run by merchant A and the cross sales are for sites run and processed by merchant B. Thus, it appears that you can still get slammed with cross sales if the cross sale is for a site or product owned by the same company. Apparently the billing processor Epoch is in full compliance with the new rules. Proof once again to think twice before using lesser known billing processors. The end result is that I think we'll see fewer prechecked cross sales overall but the practice will still continue, especially with the large porn companies that have multiple sites. I'm sure some of the smaller sites using foreign processing companies will still try and go the traditional "bait and switch" route relying on the fact that they're just small fish that Visa might not care that much about. I honestly don't see why Congress couldn't pass a simple law banning the principal. Such a law wouldn't have to apply only to porn but would cover all sites. Simply make it so that prechecked sales to US residents are prohibited and require a separate web page for consumers to check the special "ripoffs" ... I mean "offers" that they want. Some in the porn industry will bitch about this because it cuts into their revenue but I say if your business model heavily relies upon duping customers then maybe you and Bernie Madoff should be spending some quality time together making license plates for $2 a day. Hmm...I guess it all depends on how one defines the term "customer's consent"--one of the slipperiest of slopes in the modern world if you ask me. For example, how many people ever stop and read the visitor/customer agreements on adult websites before hastily clicking "Yes!" in a horny fury of puerile curiosity and wonder? For all I know I've "consented" to some questionable clauses, it's just that I've never taken the time to read and think them through. Pre-checked cross sales are the logical step under these circumstances and they seem to happen in plenty of other places as well. I recently bought some tickets to an upcoming concert through one of the big national ticket retailers/monopolies (okay, maybe the ticket monopoly)--a $25 ticket price with an additional $6+ in "convenience" and "service" fees that you only see at the last step before you're about to pay! Or think of all the agreements you click through to install software--what's the point if you already bought the damn program?! I guess one more binding agreement to keep you from even thinking of ever getting any kind of compensation from a corporation if something ever goes wrong with its products/services. Either way you're stuck being basically forced to "consent" to a lot more than you should have to and companies looking to soak up of every penny of yours they can get their hands on. I guess you pay through an unknown billing company at your own peril and damn the consequences.

Yeah, you get pre-checked cross sales from anti-virus companies ("Download insurance" -- what a load of bullshit that is!) and from the credit bureaus. Think Uncle Sam is interested in representin'? Well, NOT US! I wanted something new, so I left England for New England. | |

Well, Consent can be either expressed or implied. For example, participation in a contact sport usually implies consent to contact by other participants, when contact is permitted by the rules of the sport. Express consent exists when verbal or written contractual agreement occurs. If a person signs a document stating that he or she is aware of the hazards of an activity, and that individual is then injured during that activity, the express consent given in advance may excuse another person who caused an injury to that person. Another variation on this is the inverse tick box. Where you have to leave it ticked if you don't want it. Not prevalent, but I have seen it used. Cap'n. It almost sounds like you're discussing strategy in chess. Which is more fun, I wonder: playing chess, buying a car, or signing up for a new porn site. Lol. I try to keep my porn buys simple. I can't remember ever seeing an inverse tick box. But my memory is not that great, so I can't be positive. Another thing to watch out for. | |

It is always worth reading the text adjoining tick boxes carefully. Having thought further about it, I haven't seen it used in porn site sign ups yet, only on newsletters, email flyers & such. Damn....Just given them another idea. Cap'n.
