(Photo: Facebook) A husband caught his wife cheating, and now he’s facing up to 15 years in jail. Sean Donis’s wife, Nancy Donis, 38, said she was going to dinner. Donis stayed behind to watch their 5-year-old son. When he couldn’t find his iPad, he turned on the Find My iPhone app to locate it. The software showed the electronic device moving toward an unknown location; he had a hunch that his wife had taken it, and he decided to follow. He arrived at a house and opened the unlocked door. On the second floor, he found his wife in bed with her boss, Albert Lopez, 58. With his iPhone, he recorded two brief videos of them in bed. The New Jersey man got a letter last July informing him that a grand jury had indicted him on charges of felony burglary and unlawful surveillance for the April 2016 incident. “I feel like it’s unjust what they’re doing to me,” said Donis, 37, to the New York Post in September. “It’s like I’m being punished twice.” He appeared in court in September, where he pleaded not guilty. His second appearance happened on Friday. “I was in fear,” Lopez testified of the moment when Donis caught him in bed with his wife. “I kept telling him, you need to get out of here,” Lopez told the jury hearing Donis’s felony burglary case. Donis’s wife worked for Lopez as the billing manager for his orthopedics practice. Lopez said he was so desperate to get the enraged husband out of his home that he asked Donis “if he wanted to die.” “Kill me. I don’t care,” he said the desperate husband responded. The incident left Lopez traumatized. “I couldn’t go to sleep. I had repeated memories of what occurred. I started to go through the house and check all the doors and make sure they were locked,” he said. Lopez also noted that Donis’s wife said they were separated, and he thought Donis was out of the picture. The husband’s lawyer, Howard Greenberg, told jurors that the husband actually “deserves a medal,” not a prison sentence, for uncovering his wife’s unfaithfulness without physically harming his rival. “The defendant should be given a medal for the amount of restraint he showed when he entered that scene,” Greenberg told the jury. However, despite the fact that Lopez slept with Donis’s wife, prosecutor Nabeela Mcleod asserted that Lopez was a victim — a victim of Donis’s breaking and entering his home and recording him and Donis’s wife without their consent (Donis shared the videos with his wife’s relatives). Owners Justin and Tori Englehardt found the dead bees when they went to clear snow off the hives on their 18-acre property. “We found complete destruction of our hives and supply shed,” they wrote on their Facebook page. “They knocked over every single hive, killing all the bees. They wiped us out completely,” Justin Engelhardt told The Sioux City Journal. “They broke into our shed, they took all our equipment out and threw it out in the snow, smashed what they could. Doesn’t look like anything was stolen; everything was just vandalized or destroyed. He called the crime “completely senseless.” The loss was estimated at $60,000. The devastation was so complete that the couple feared they couldn’t afford to revive the six-year-old operation. The business wasn’t insured; bee operations usually can’t get insurance, according to Engelhardt. But a friend of the Engelhardts started a GoFundMe page that quickly raised more than $30,000 in donations. They now plan to rebuild. “We cannot adequately express how grateful we are to everyone who has sent kind words and to those willing to help us out. It’s been overwhelming,” the couple wrote on their Facebook page. “We had no idea our plea for help with identifying the vandals was going to travel so far and wide. People have been so generous, we will definitely be able to bring our bee sanctuary back to its former glory. Thank you to everyone for your support and understanding.” Engelhardt believes the response was so overwhelming because people care about honeybees and their struggle for survival. “Bees are critical and people are conscious of the fact that bees are having a hard time right now and facing some real challenges,” Englehardt told The Sioux City Journal. The boys face three felony charges for criminal mischief, agricultural animal facilities offenses and burglary, according to a news release by the Sioux City Police Department. This is getting really confusing. Today, I read that Zachary Levi will star in the film "Shazam!" as the superhero Captain Marvel. But there are earlier reports that Brie Larson (an actress, who is a woman) will star in a movie currently titled "Captain Marvel" as the superhero Captain Marvel. Both films will open in 2019. So Captain Marvel is a man. Captain Marvel is also a woman. When I was a child, I read comic books about Captain Marvel, who was a boy who turns into a man when he utters the secret word: Shazam. I haven't read comics for many years now. But I assume that there is now a female Captain Marvel. But 2 different movies, about Captain Marvel? One a man Captain Marvel. One a woman Captain Marvel. Why should I be confused? I should have realized a long time ago that comics (and movies) don't need to have a continuous history. That plots can be contradictory. Illogical. And if you are foolish enough to point out the inconsistency of a movie, people will often say it's just a movie, so it doesn't need to be consistent. | |

It was an arresting experience that has remained cemented in memory. In that moment, I suddenly understood the uncanny valley, a theory posited by roboticist Masahiro Mori, nearly half a century prior. It attempts to explain the feeling of revulsion and eeriness that human onlookers experience when they encounter an artificial life-form that appears nearly, but not quite human. Today, she's ventured out of the dimly lit R&D room at Abyss Creations to meet me at CES. On the eve of her debut, Harmony has ventured to the hotbed of consumer electronics with a new face, an updated AI and a few new friends. When I first met Matt McMullen, Harmony's creator and human chaperone, he planned to launch what I've called the world's first commercially viable sex robot in late 2017. Harmony's AI would be customizable via an accompanying Android app, but with limitations. While he had plans for a male version and mused about other gender variations, Harmony would launch as an artificial female with porn star proportions. Harmony failed to launch in 2017, but McMullen and his team have been hard at work, making improvements to Harmony's AI and the robotic head it's housed in. He's now targeting the end of this month for a release date, and while he's says he's still refining the pricing, Realbotix modular robotic heads should cost between $8,000 and $10,000 at launch. Just minutes after the lights went out at the Las Vegas Convention Center, Harmony lit up in a hotel just across the street. Perched on a bust that could just as easily be used to display jewelry, she made small talk and recited a few dad jokes. After a year of contemplation, I no longer felt the same uneasiness I had during our first encounter. It could be that the novelty has worn off or the fact that Harmony was basically a head on a stick. It could have been CES AI fatigue, but the existential anxiety was gone. For the most part, Harmony is the same robot that we saw last year, but the Realbotix app, which eager robophiles can be download now, now has a remote control mode. In our first demo, Harmony ran exclusively in autonomous mode, and while McMullen says the remote control functionality may not make it into the consumer app, it would make for a sweet party trick. I was able to control Harmony's head movements and facial expressions and dictate what she said. I, of course, took the opportunity to have her tell me how fabulous I am and for a moment I felt like some sort of dystopian puppet master. This is the future, after all, that some of McMullen's critics fear. In a world where robotic companions are endlessly amenable, how will we treat our fellow humans? This, and other broad ethical concerns are currently swirling around robotics labs and in academic circles. The sex-robot debate has even made its way to CES, but McMullen remains wholly dedicated to his vision of delivering a sexualized humanoid -- albeit one that could be used for non-sexual companionship. After demoing Harmony's admittedly corny stand-up abilities, McMullen removed her wig exposing a mess of circuits, motors and wires. He then peeled back the silicone surface of her face to reveal a foam skeleton peppered with an array of small, round magnets. Those magnets will allow users to replace damaged faces or swap them out for different visages altogether. Within moments Harmony was someone completely different. She had a brand-new mug and a different voice to match. Just like that Harmony was Solana and that eerie feeling crept back in. By the way: I would prefer that if a site goes inactive, or PU declines to do business with them, that PU still list the site, with a disclaimer: The disclaimer could be that the site is inactive, that PU no longer does business with them, or whatever PU feels is appropriate. But showing the site with the disclaimer, would give PU members a bit more information, than simply erasing the site from the PU site. Alleged swatting hoax ends in the death of a father of two (updated) Engadget Mallory Locklear,Engadget 2 hours 43 minutes ago Yesterday evening, a 28-year-old Kansas man was shot by police after the station received a call about a hostage situation taking place at the man's residence. "It was a shooting call involving hostages," Deputy Police Chief Troy Livingston said during a press conference last night. "The original call, we were told that someone had an argument with their mother and dad was accidentally shot. And that now that person was holding mother, brother and sister hostage. We learned through that call that a father was deceased, and had been shot in the head. That was the information we were working off of." But that information turned out to be wrong and shortly after the incident, reports began to surface online that the call was part of a "swatting" stunt -- a hoax wherein someone makes a false police report in order to fuel a large law enforcement response. Here's what seems to have gone down. Two individuals were playing Call of Duty and got into an argument online over a game with a $1.50 wager. One of them, a person with the Twitter handle @SWauTistic, threatened to swat user @7aLeNT. The latter then provided an address that wasn't actually their own in response to the threat. Shortly thereafter, @SWauTistic allegedly called in the false report, which led to a police response at the provided address. Andrew Finch, who lived at the address, reportedly went to the front door in response to the commotion and was shot. "As he came to the front door, one of our officers discharged his weapon," said Livingston. The police haven't said whether Finch had a weapon at the time, but his family has said there were no guns in the house. The officer who fired the shot is a seven-year department veteran who will be put on paid administrative leave pending an investigation. Once the story began attracting media coverage, @SWauTistic tweeted that the house he swatted was on the news, which was then followed by a tweet saying he didn't get anyone killed because he wasn't the person who shot Finch. (@mattcarries) KrebsOnSecurity reports that the individual then changed his Twitter handle to @GoredTutor36, but not before KrebsOnSecurity got its hands on weeks' worth of the original account's tweets. The person behind the account has claimed credit for a number of swatting hoaxes and other threats including one that led to the evacuation of the Dallas Convention Center earlier this month, a bomb threat at a Florida high school in November and the threat that caused the FCC to pause its net neutrality vote a couple of weeks ago. In direct message conversations with KrebsOnSecurity, the person running @GoredTutor36 said that they had remorse over Finch's death but that they would not be turning themselves in. "People will eventually (most likely those who know me) tell me to turn myself in or something. I can't do that; though I know its [sic] morally right. I'm too scared admittedly," they wrote. They also said, "Bomb threats are more fun and cooler than swats in my opinion and I should have just stuck to that. But I began making $ doing some swat requests." The person also noted that the thrill of such hoaxes "comes from having to hide from police via net connections." Finch was a father of two children -- a two-year-old and a seven-year-old -- and his family said he didn't play video games. The studio is not only launching a streaming site to compete with Netflix, but demanding from domestic exhibitors a firm 65 per cent aggregate film rental –the percentage of ticket sales that theaters return to studios– for “Star Wars: The Last Jedi.” This is yet another sign of the top-ranked studio’s confidence and assertiveness. There’s reason for cock-of-the-walk status. Over the last two holiday seasons, Disney’s first two reboots in the “Star Wars” franchise amassed nearly $1.5 billion in domestic gross, in both cases the biggest release of their respective years (on the all-time adjusted charts, #11 and 57). Disney’s bold move is underscores its proximity to becoming more powerful than any studio in the history of Hollywood. And it comes as their successful brand label strategy looks impossible to replicate for the foreseeable future. The company is all over the news, with the strong opening of “Thor: Ragnarok,” their brief banishment of the Los Angeles Times media from screenings due to negative coverage of the studio’s Anaheim theme park Disneyland, their proposed sky-high film rental terms for “Star Wars: The Last Jedi,” and now the possibility of a takeover of key assets from 21st Century Fox, including their television and movie production and distribution entities. Warner Bros. will have 18 new releases by comparison to Disney’s eight. It was little noticed at the time, but Disney managed to go a third of the year — four months — without a single new film. From mid-June (“Cars 3”) until “Thor: Ragnarok” this past weekend, nothing was in release. This is the apotheosis of what most studios have been heading toward. Disney Studios have become the equivalent of their parks. They have Pixarland (“Cars 3,” “Coco,”), Marvel World (“Guardians of the Galaxy Vol. 2,” “Thor: Ragnarok”), Fairytale Village (“Beauty and the Beast”) Disneyworld (in-house animation like “Moana”), even a long-running franchise named after a ride (“Pirates of the Caribbean”). Their tentpole emphasis means they are abandoning other lower-profile genres Among the highlights of 2017 domestically have been “It” (horror film), “Get Out” (Hitchcockian race-themed thriller) and “Dunkirk” (older audience historical epic). Disney is no longer interested in those market niches. As usual, Disney’s focus for the Oscar race is largely animation and tech recognition, in a year when hits like “Get Out,” “Dunkirk,” and “Wonder Woman” look to raise studio involvement to an above-average level. That means Disney needs to win commercially with their expensive films. That is working. Universal is scoring with high-end series like “Fast and Furious,” “Despicable Me” and its sequels, but also cheap genre titles like “Get Out” and “Split.” Warners has expensive D.C. Comics tentpoles but also the major profit maker “It.” They and others mix franchises and originals. Disney has doubled down on a far more narrow emphasis. There’s no question that more times at bat increases the chance for a breakout success. But Disney’s strategy manages to save money. Every wide release, whether the production budget is $5 million or $250 million, requires an expensive marketing and distribution outlay (for domestic $25 million or more low end). So that adds huge costs to a large slate packed with titles. Back then theaters didn’t play all the studios movies. Until the majors were stripped of their theaters by anti-trust decrees in 1948. Today that is impossible. If one studio provides up to one quarter of your annual ticket sales (concessions also provide a substantial amount of theaters’ profits), these days the idea of living without their product is impossible. Nearly all multiplexes play the same movies, many within close range of competitors, and cannot risk not playing key titles. Until recently, studios maintained a regular flow of product through their pipeline because they felt it most effectively utilized their distribution staff and kept theaters dependent on them year round. But Disney has changed this model. Indeed, the downturn in box office starting in July paralleled the company’s absence from screens. At the end of June (two weeks after “Cars 3”) year to date was actually slightly up. After two months of no Disney films, down 6.3 per cent. September with “It” improved things, but October brought another down tick. The strong Disney slate for the rest of the year will improve things somewhat, but not enough to match last year’s total. The message seems clear: exhibitors can’t live without Disney. The downside of Disney’s power Not all film grosses return the same amount to distributors. Studios get a bigger return from theaters than independents. big grossing films get more than smaller ones. But as they push out smaller, mid-level films (including what Disney used to make), they ensure that for exhibitors, showing films costs more. The rough guess is big chains pay around 55 per cent for wide releases on average. But as more of the business shifts to presumed blockbusters (as opposed to surprises like “It” or “Get Out”) film rental inevitably rises. Deputies from the Polk County Sheriff's Office responded to a call about a woman who appeared confused and possibly in danger riding a horse on Combee Road Thursday afternoon, reported the Orlando Sentinel. Authorities arrived at the scene to find Donna Byrne riding the animal in the middle of the road. She had red, watery eyes and reeked of booze, according to Polk County Sheriff’s Office spokesman Brian Bruchey. A field sobriety test revealed that Byrne's B.A.C. was a staggering .161, more than two times the legal limit. Along with the DUI, Byrne was charged with animal neglect for failing to provide proper protective gear for the horse, placing it in jeopardy. NBC News reported that Byrne's prior criminal record includes five felony and ten misdemeanor charges, consisting of cruelty to animals, drug possession, probation violation and criminal traffic. “Ms. Byrne was obviously not in any condition to be on the road," said Polk County Sheriff Grady Judd. [1] During 1955 to 1960, he had eleven top 10 hits and his record sales were reportedly surpassed only by Elvis Presley.[2] Domino's musical style was based on traditional rhythm and blues, accompanied by saxophones, bass, piano, electric guitar, and drums.[1] Domino was born and raised in New Orleans, Louisiana, the eighth and final child of Antoine Caliste Domino (1879–1964) and Marie-Donatille Gros (1886–1971). The Domino family was of French Creole background. Louisiana Creole French was his first language. Antoine was born at home with the assistance of his grandmother, a midwife. Rassim Khelifa from the University of Zurich, Switzerland, witnessed the behaviour for the first time in the moorland hawker dragonfly (Aeshna juncea). While collecting their larvae in the Swiss Alps, he watched a female crash-dive to the ground while being pursued by a male. The female then lay motionless on her back. Her suitor soon flew away, and the female took off once the coast was clear. “I was surprised,” says Khelifa, who had never previously seen this in 10 years of studying dragonflies. Female moorland hawkers are vulnerable to harassment when they lay their eggs since, unlike some other dragonflies, they aren’t guarded by their male mates. A single sexual encounter with another male is enough to fertilise all eggs and copulating again could damage their reproductive tract. Khelifa found that the females often retreat to dense vegetation near ponds at this time, probably to hide. And they often act dramatically when they emerge. High-speed plunge He observed 27 out of 31 females plummeting and playing dead to avoid males, with 21 of these ploys successful. Plunging at high speed is risky though, and according to Adolfo Cordero-Rivera at the University of Vigo in Spain, it may be a strategy that they use only in areas with lots of dragonflies. “Females may only behave in this way if male harassment is intense,” he says. Few animals have been caught feigning death to trick suitors. The behaviour has been seen in a species of spider (the males use it to improve their chances of mating), two species of robber fly and a type of mantis. Playing dead to avoid predators, however, is more common and has been observed in dragonflies. “It’s likely that females expanded its use to overcome male coercion,” says Khelifa. Khelifa is interested in finding out whether the behaviour is unique to species that lay eggs alone or whether it is more widespread. Using extreme tactics to resolve sexual conflict isn’t unique to moorland hawkers: in their damselfly relatives, for example, females eat their partner. Serebrennikov is accused of embezzling 68 million rubles ($1.15 million) in state funds, which was intended for a theater project called “Platform,” through his nonprofit organization Seventh Studio between 2011 and 2014. The director and several employees of Seventh Studio were previously detained and questioned by investigators in May. Serebrennikov’s apartment and Moscow’s Gogol Center, where he has served as artistic director since 2012, were both searched at the time. Serebrennikov denies all allegations, calling them “absurd” in court. He says the funds were used to stage genuine productions. His supporters, who chanted “Freedom!” outside the court, contend that the charges against him are part of a government crackdown on artistic freedoms. News of the Justice Department order landed Monday when the company took an unusual step of announcing that it had been in talks with the government to clarify and narrow the search warrant in an effort to comply, but had failed to reach an amicable resolution. The order demanded that the company provide "all information available", including its owner and its visitors, of a political activism and protest organizing website against the current Trump administration, the web host said in a blog post. The website, known as DisruptJ20, is a political organization that planned a mass protest for the inauguration of then president-elect Donald Trump in January. Several purported members of the organization were arrested for alleged violent conduct during the protests. The specific information that prosecutors want isn't known as the affidavit for the search warrant remains under seal. Dreamhost has however confirmed the order demanded the company hand over "contact information, email content, and photos of thousands of people," to determine "who simply visited the website," the company said. The company argued that the data, including logs and specific identifiable information, will allow the government to build a comprehensive list of names who oppose the Trump administration. Specifically, the company argued that the warrant "not only aims to identify the political dissidents of the current administration, but attempts to identify and understand what content each of these dissidents viewed on the website." "That information could be used to identify any individuals who used this site to exercise and express political speech protected under the Constitution's First Amendment," the blog post read. Dreamhost as a result filed its opposition to the order late last month, arguing that the search warrant "violates" the Fourth Amendment against unreasonable searches and seizures. The Electronic Frontier Foundation, a privacy group currently representing Dreamhost, said in a statement that the Justice Dept's order was "unconstitutional". "No plausible explanation exists for a search warrant of this breadth, other than to cast a digital dragnet as broadly as possible," said Mark Rumold, a senior staff attorney. "But the Fourth Amendment was designed to prohibit fishing expeditions like this," he said. "Those concerns are especially relevant here, where [Justice Dept] is investigating a website that served as a hub for the planning and exercise of First Amendment-protected activities." His company makes the very popular Roomba robotic vacuum cleaner. On Monday, ZDNet's Jake Smith wrote about iRobot's intention to sell mapping data from customers' homes to other companies. Dear Colin, One of the ways Webster defines "dear" is "highly valued" or "precious." So when I start a letter with "Dear Colin," you could interpret my statement as saying I highly value our relationship. But the fact is, we've never met and I'm just using a commonly accepted way of starting a letter. This is relevant to our discussion because you've recently talked about taking from your customers information that is dear to them, even though you've never met most of the people who enjoy the benefits of your products. When your customers buy your products, there are some common expectations. It looks like you may be thinking about or trying to violate those expectations. While you didn't dive into technical details in that interview, I can definitely infer from your comments how a robot given free roaming privileges in a home or office space might build up a map of that space. With good sensors, it might even be able to place the exact location of other smart devices on that map. And, by combining image analysis with radar or sonar, and with radio signal analysis, a room-roaming robot might be able to derive a useful representation of an environment. That data could be used to help maximize lighting, tune sound, optimize microphones, determine when people or pets are in a space, and help conserve energy. All that is good. I can even see how you might want to develop interoperability with the other big players in the home space, whether that's Amazon and Alexa, Apple, Google (particularly for Google Home), and others. The tech industry has a long and well-regarded history of building APIs and inter-app communication protocols (XML and JSON come to mind) for creating systems that are greater than each of the individual components. If you want to work with Apple, Amazon, and Google -- with our permission to use our private information, of course -- to help create better home automation environments, I'm good with that. But here's the thing that has the whole internet a-flutter. Apparently, you're trying to sell that mapping data. I understand that iRobot is a smaller company than any of the big three, but once you get into the mode of selling data, the potential for abuse rears its oh-so-ugly head. After all, if you're just developing good interop, there's no reason to look at selling that mapping data. But when you're talking about selling data that describes our homes to companies like Amazon and Google -- companies that thrive on being able to get inside our heads and our wallets -- something far more disturbing comes to mind. You're no longer mapping our homes to make sure you don't tear out a power cord or fall down a flight of stairs. You're moving into the realm of spying on your customers. In your case, though, it's far worse than those stories of possible always-on webcams or TV sets. See, none of those other devices can move around the house on their own power. If my TV is in the living room, I know it's there. If I'm concerned about my privacy, I'm probably not going to parade my naked butt in front of it. But a Roomba can decide to wake itself up, it can wander around the house, it can measure, map, and with your onboard camera, even take pictures. What would you do with the pictures your Roomba snags? Would you send them to Amazon's or Google's machine learning so they can develop an inventory of our possessions? What could they do with that information? It's not just a worry that they might discover I like coffee and pitch me on better coffee beans. It's that they might learn about medical conditions, lifestyle choices, or anything else we want to keep private. Where would that information go? Would you give it up to the government if you got a National Security Letter or subpoena? Now, at least, if our houses are searched by a government entity, we'd have a pretty good chance of knowing because someone will have to enter with a warrant. But if your robots are spending their days mapping, snapping, and spying, will we even know who our data is shared with? And what about foreign or terrorist organizations? How good can spear phishing get if the bad guys truly know our interests and our home environments? You might not know you're selling data to ISIS or Iran, or even China. The concept of a front company has been around for a very long time. Sure, we live in a time where selfies and YouTube and Facebook and Instagram mean we voluntarily give up enormous levels of privacy. But that's our choice, even if it might be a foolish one. But here's where you might be going wrong. If you're asking for permission to map homes to provide better service capabilities, that's one thing. But if you're capturing all that data, storing it on your own servers, and then selling it to any random buyer that comes along, then you're spying. I know you're familiar with Isaac Asimov's Three Laws of Robots. But for our readers, let's recap them here: A robot may not injure a human being or, through inaction, allow a human being to come to harm. A robot must obey the orders given it by human beings except where such orders would conflict with the First Law. A robot must protect its own existence as long as such protection does not conflict with the First or Second Laws. I know you're familiar with these laws because you chose to name your company, iRobot, after the classic book in which Asimov's Laws debuted, I, Robot. Colin, by potentially selling or sharing information about our lifestyles that is dear to us, you may well be violating the First Law. And if you know your Asimov, you know that won't end well. | |

Sekulow and his family may be in violation of a federal law prohibiting nonprofits from paying "excessive benefits" to the people running them, according to experts who spoke to The Guardian. Here are some parts of the nonprofit that stood out, according to The Guardian: Millions of dollars in donations were used to pay Sekulow, his wife, his sons, and his extended family. Judge finds Michelle Carter guilty of manslaughter in texting suicide case By Ray Sanchez and Natisha Lance, CNN Updated 5:22 AM ET, Sat June 17, 2017 Story highlights Conrad Roy III, 18, killed himself in July 2014 A Massachusetts judge decides Michelle Carter's fate after she waived her right to a jury trial (CNN)In a case that hinged largely on a teenage couple's intimate text messages, Michelle Carter was found guilty of involuntary manslaughter Friday in the 2014 death of her boyfriend, who poisoned himself by inhaling carbon monoxide in his pickup truck, a Massachusetts judge ruled. Carter's own words -- preserved in hundreds of text messages presented as evidence over six days of testimony -- helped seal her conviction in the death of 18-year-old Conrad Roy III, Bristol County Juvenile Court Judge Lawrence Moniz said during a 15-minute explanation of his rationale. "She admits in ... texts that she did nothing: She did not call the police or Mr. Roy's family" after hearing his last breaths during a phone call, Moniz said. "And, finally, she did not issue a simple additional instruction: Get out of the truck." Carter, 20, cried silently as Moniz spoke. She stood to receive the ruling, which could set legal precedent for whether it's a crime to tell someone to commit suicide. 'There are no winners here' Prosecutors had argued that Carter sent Roy numerous text messages urging him to commit suicide, listened over the phone as he suffocated and failed to alert authorities or his family that he'd died. The judge agreed. "This court has found that Carter's actions and failure to act where it was her self-created duty to Roy since she put him in that toxic environment constituted reckless conduct," the judge said. "The court finds that the conduct caused the death of Mr. Roy." With Carter standing, Moniz said, "This court, having reviewed the evidence, finds you guilty on the indictment with involuntary manslaughter." Although Cater was not present when Roy killed himself, her text messages and conversations with him proved damning. One July 2012 exchange of texts messages was typical: Roy: "I'm overthinking" Carter: "I thought you wanted to do this. The time is right and you're ready, you just need to do it! You can't keep living this way. You just need to do it like you did last time and not think about it and just do it babe. You can't keep doing this every day." Roy's relatives, who sat near Carter in the front row of the courtroom, wept as the judge ticked through the steps Roy took to end his life, as well as Carter's complicity. Sitting opposite them, Carter's family members also sobbed. "Although we are very pleased with the verdict, in reality there are no winners here," prosecutor Katie Rayburn told reporters later. "Two families had been torn apart and will be affected by this for years to come. We hope verdict will bring some closure... It's been an extremely emotionally draining process for everyone involved." Roy aspired to be a tugboat captain and would be alive if not for Carter's actions, Rayburn said. He had been trying to better himself, and "we all wish he had the opportunity" to grow up, she said. Added Roy's father, Conrad Roy Jr.: "This has been a very tough time for our family, and we would just like to process this verdict that we are happy with." Moniz let Carter, who was tried as a juvenile because she was 17 at the time of the crime, remain free on bail until her sentencing on August 3. She could face up to 20 years in prison, though experts say such a lengthy sentence is unlikely. She was ordered to have no contact with members of the Roy family. She cannot apply for or obtain a passport, nor can she leave Massachusetts without permission from a judge. Case was watched closely The ruling, which may spur lawmakers to codify the behavior highlighted in the case as criminal, was closely watched by legal experts. "Given the expansive definition of manslaughter under Massachusetts law, the guilty verdict is not a surprise," CNN legal analyst Danny Cevallos said. "Still, this verdict is concerning because it reflects a judicial willingness to expand legal liability for another person's suicide, an act which by definition is a completely independent choice," he said. "Historically, suicide has been considered a superseding act which breaks the chain of legal causation." In charging Carter with involuntary manslaughter, prosecutors were threading a legal needle, another legal expert said. "I thought it was a square peg in a round hole, it wasn't a great fit for manslaughter," Daniel Medwed, professor of law and criminal justice at Northeastern University, said after the decision. "Her behavior was so morally reprehensible, but I wasn't sure how, as a matter of law, it constituted as manslaughter." Medwed said manslaughter involves direct action such as a drunk driver who slams into a car or someone who fires a gun into a crowd to recklessly cause a death. "This case involves mainly words, but ultimately [Roy] decided to do the deed, so it didn't fit in with the classic patter of manslaughter," he said. "But the facts are so powerful, so compelling and her behavior so apparent that I'm not shocked she got convicted for manslaughter." Texts drove suicide, prosecutors argued Carter secretly nudged Roy toward suicide by sending him numerous text messages encouraging him to take his life, prosecutors said. In closing arguments Tuesday, prosecutors said Carter berated her vulnerable boyfriend when he had second thoughts about killing himself, listened by phone as he died and used his suicide to get from friends the attention that she desperately craved. Teens and texts: Suicide case exposes risks of messaging Carter went from offering "words of kindness and love" to aggressively encouraging Roy via text message to carry out longtime threats to commit suicide, Rayburn told the court. "It got to the point that he was apologizing to her, ... apologizing to her for not being dead yet," she said in her closing argument. Rayburn reminded the judge of text messages in which Carter encouraged Roy to get back in the truck. In text messages to a friend, she described hearing his final words and breaths on the phone. Roy's body was found July 13, 2014, a day after his suicide in his parked truck in a Kmart parking lot in Fairhaven, nearly 40 miles from his home. 'Tragic ... not a homicide,' defense said Carter's attorney argued she was a troubled, delusional young woman who was "dragged" into the suicidal journey of Roy, who had long been intent on killing himself. Assistance or coercion? Intent is key in text message suicide case, experts say "The evidence actually established that Conrad Roy caused his own death by his physical actions and by his own thoughts," defense attorney Joseph Cataldo said. "You're dealing with an individual who wanted to take his own life. ... He dragged Michelle Carter into this." Carter was "overwhelmed" by Roy's talk of suicide while at the same time dealing "with all of her baggage," including the side effects of medication for depression, Cataldo said. "It's sad, it's tragic," he said. "It's just not a homicide." Earlier in the trial, a psychiatrist testified that Carter was delusional after becoming "involuntarily intoxicated" by antidepressants. She was "unable to form intent" after switching to a new prescription drug months before Roy's suicide, and she even texted his phone for weeks after he died, the psychiatrist testified. The Electronic Frontier Foundation (EFF) filed a Freedom of Information Act lawsuit against the Trump administration’s Justice Department, demanding access to records about any FBI training and payment to Geek Squad workers to search customer computers without a court warrant. At issue isn’t the criminality of child pornography or efforts to stop the exploitation of children by sexual predators. EFF is concerned that the FBI may be violating the constitutional requirement that law enforcement agencies obtain judge-approved search warrants, based on evidence there is probable cause of a crime, to search computers. “Informants who are trained, directed, and paid by the FBI to conduct searches for the agency are acting as government agents,” EFF civil liberties director David Greene said in a written statement. “The FBI cannot bypass the Constitution’s warrant requirement by having its informants search people’s computers at its direction and command.” The San Francisco-based non-profit privacy group sued the Justice Department after it refused a request for documents about how the FBI recruits, trains, and pays Best Buy workers to find illegal child pornography on customer computers sent to Best Buy for repairs. “The public has a right to know how the FBI uses computer repair technicians to carry out searches the agents themselves cannot do without a warrant,” EFF senior counsel David Sobel said in a statement. “People authorize Best Buy employees to fix their computers, not conduct unconstitutional searches on the FBI’s behalf.” The FBI refused to provide records to EFF based on the agency’s policy of not confirming or denying ongoing investigations. But court documents in federal court in Santa Ana, California, argue that the FBI has launched a program of training and paying Geek Squad employees to look for child pornography on customer computers sent in for repairs, and to report the porn to authorities. Moon, a liberal former human-rights lawyer, was elected with 41% of the vote Tuesday to replace disgraced former President Park Geun-hye. Park was impeached, and now languishes in jail as she faces criminal charges of corruption and abuse of power. Moon was sworn in Wednesday morning. He says he will reverse policy in many of the areas where Park faces legal proceedings, including in South Korea’s film industry, the world’s sixth-largest. Supported by her political cronies, including former culture minister Cho Yoon-sun and chief of staff Kim Ki-choon, Park was involved in blacklisting more than 9,000 cultural figures deemed to be anti-government. The list was compiled to exclude artists and companies from state-controlled funding programs. Moon has pledged to undo the damage of Park’s interference in the arts. “The blacklist is a national violence [against art and artists] that infringed upon the fundamental basis of democracy,” he said in April. He also wants the resignation of the heads of state organizations, such as the Korean Film Council, that acquiesced to Park’s demands. It was recently revealed that the council had tried to sway public opinion by anonymously submitting a newspaper column justifying drastic budget cuts to the troubled Busan film festival. The council’s chairman, Kim Sae-hoon, is now on the verge of resigning. The Busan film festival’s woes were sparked by the local mayor’s intervention in the fest’s programming in a bid to protect Park’s image. Moon has gone on record as saying that sitting mayors should not be allowed to serve as festival heads. He has said he would provide an institutional strategy to protect film festivals’ independence and autonomy. Under Park, a state-controlled fund accessed by nearly 40% of Korean films each year was diverted to give more support to pro-government, nationalistic movies. Critics say that the fund’s manager, the Korea Venture Investment Corp., operated as a de facto censor. Moon says he wants to reduce the size of the profit-seeking fund, currently worth $880 million (KRW 1 trillion), and to support art-house and indie titles. IMDb adds 'F-rating' to identify female-focused films Published March 07, 2017 FoxNews.com The Internet Movie Database (IMDb) now features an "F-rating" to identify films that are feminist-friendly. Film that feature a female director, a female writer, sees "significant women on screen in their own right" or passes the Bechdel test will receive the special rating. The Bechdel Test was first established in 1985 by comics writer Alison Bechdel. In order to pass the test, a film must feature two female characters talking to each other about something other than a man. "The F-Rating is a great way to highlight women on screen and behind the camera," IMDb founder and CEO Col Needham told The Telegraph. Films that don't feature a female director or writer can still earn an "F" as long as they pass the Bechdel Test. So far, 21,800 films on IMDb have an "F" including "Kung Fu Panda 2," "The Girl on the Train," "Gentlemen Prefer Blondes" and "The Parent Trap." Some films can earn a "Triple F" rating if they meet all three conditions. Those films include "Frozen," "American Honey" and "Bridget Jones’s Baby." New Line, which has been for over a decade developing a movie on the longtime DC character, will concurrently develop a movie centering on Black Adam, with Dwayne Johnson attached to star as Shazam’s arch-nemesis. Johnson has been attached to play Black Adam since around 2008. Since that time, he has become arguably the biggest male actor on the planet. To execs, it made no sense to have a man of Johnson’s stature be just a villain and a supporting character in an expensive tentpole. Thus a decision was made to spin off Black Adam into his own film. Adam’s screen take involves him being an antihero. No writer or filmmaker is attached to Black Adam. Shazam! has a script that is being worked by Henry Gayden, according to one source. One of the oldest comic characters around, Shazam was originally known as Captain Marvel. Theaters in my area already charge $10.50 for senior tickets. I hardly ever go to a theater any more. If prices go higher, I will be going even less than I do already. I wait for the movie on cable TV, or on Disc. That's my normal habit, today. Would I pay $25 to see a movie in a theater? The theater chain feels that it’s standard business practice in most industries to charge more for in-demand products, so they are considering bringing that practice to movie theaters. Get ready for the possibility of dishing out more of your money when you go to the movies. According to the Hollywood Reporter, it could be happening soon. They report that AMC Entertainment CFO Craig Ramsey was speaking at the MKM Partners Entertainment, Leisure and Technology Conference, when he announced that AMC is seriously considering this idea. AMC was inspired by two European theater companies they recently acquired--Odeon and UCI--to initiate a model of variable pricing. Ramsey said, “They are further advanced in variable pricing, where tentpole movies are priced-up upon release. That’s something we’ve talked about in the US. We expect to learn a lot with what they’ve done. We think it will position us to start having those conversations about pricing opportunities in the US.” Interestingly, Steven Spielberg and George Lucas warned of this back in June of 2013, when speaking at the University of Southern California. They predicted that in coming years, there would be variations in ticket prices based on the budget of the film. They warned, “You're gonna have to pay $25 for the next Iron Man, but you're probably only going to have to pay $7 to see something like Lincoln." Keep in mind that only AMC Theaters are currently discussing a variable pricing plan. However, if AMC is successful with this, you can be sure that all the other theaters chains will jump on the bandwagon and install their own variable pricing model. The positive side of this is that the less anticipated, small-budget films might end up costing less than they do now. So, if you want to see a Rom-Com, or Woody Allen’s latest project, you’re in luck. However, if you want to see Avengers: Infinity War or Star Wars: Episode 8, you may be paying upwards of $25 admission. I'm looking at a site that uses MBI-PROBILLER as the billing agent. I've always trusted CCBILL and Epoch, because they gave great service: easy to cancel, easy to dispute a payment (on the few times I've disputed a payment). I don't remember using MBI-PROBILLER. Are they reliable? I know that some billers are not reliable: either they are hard to contact, they give you a hard time when cancelling, charge you extra money when you want to cancel, or give you other problems. Anyone have experience with MBI-PROBILLER? Good, or bad? | |
