Hey there, I appreciate your concern, but I think I can help put your mind at ease.
These 18 U.S.C. 2257 statements are worded almost verbatim across all websites. They are a legal requirement for adult websites accessible in the United States. So they are worded quite formally and cover all potentialities whether they apply to the site you're on or not.
The exemption clause is standard and refers to where the records of the performers' ages are kept. The site is only responsible for the productions that they've overseen directly or own outright. Similar records will be the responsibility of any other companies that have supplied content to them or any advertising images promoting third-party sites.
The internet essentially didn't exist prior to 1995 and a limited number of sites would have vintage content that old. Regardless, those performers would also be over the age of 18. Once again, the exemption is referring to record keeping. The source companies would be responsible for providing proof of age.
So, to summarize, performers will always be 18+ and this legal statement refers to where official records are kept. The authorities will always be able to track down records for any content that isn't produced in-house, but the website is not directly responsible for maintaining those records.
