Shakespeare's Romeo and Juliet has been deemed to be porn by some because it suggests the deed was done while Juliet was under age. Many other examples.
Potter Stewart, a Supreme Court Justice, said, "I can't define porn, but I know it when I see it."
Potter Stewart is no longer living so I've replied instead of him.

Imagination (by either the author or reader) is not the same as reality. While shouting "Fire!" in a crowded movie theater is not necessarily protected speech, writing "Fire!" isn't going to get the same reaction. Two different beasts in my book.

In some cases as it should be a case by case decision.
