sexting The forum discussion on Roamn Pulanski got me thinking about a topic that is hot among high school and younger children. That is charging teenagers and even preteens with disseminating child pornography when they send nude explicit pictures to each other using cell phones, which is called sexting. I think we probably all agree this is a stupid and dangerous way to flirt, but is labelling them as sex offenders proper? Most young people think they should not engage in the activity, but do not see those who do this as sex offenders. | |

Well, it is the first time I have heard of that! I suppose it is a hi tech version of the adolescent game behind the bike sheds 'I'll show you mine if you show me yours!' It is ill advised & immature but, it is teenagers being teenagers, it shouldn't label them as sex offenders IMO. The problem is that they presumably are in some instances generating illegal underage pornographic material. I think legal folk will have a field day with this one! This whole "child pornography" business is going from the ridiculous to the sublime. No one in their right mind will defend child pornography but I read only a couple of days ago that a young father and mother were being charged for publishing a naked picture of their new baby on Facebook or MySpace and were in danger of losing custody. They were devastated. Remember the old embarrasing pictures of yourself naked on a bear rug that were being passed around by your proud parents. Now it's pornography. Folks are clearly hysterical when it comes to the subject and tend to throw out the baby with the bathwater. Let's all fight the real abuse instead! | |

Minors doing the sexting shouldn't be called sex offenders because they aren't of age. That just goes back to the growing problem of parents knowing what their children are doing and correcting their behavior. Admittedly, that's getting harder and harder to do, because children will always be curious and explore their world anyway they can - and they obviously know that sending pictures is a lot less risky than trying to look up Suzy's* dress on the playground. If and when there's an adult involved with the pictures, then there's a serious problem. And it's funny (although not really) that messmer mentioned putting up pictures online. I happened to tell my sister that I have a picture of my niece and nephew on my Flick'r page and she went all off the deep end. It isn't anything close to the naked on the bear skin rug variety. They were 10 and 7 in the picture and it's a shot of them climbing on my back while I'm sitting on a some steps. But damn! The paranoia people have about stuff like that is way out of control. I understand we have to protect our children, but to what extent? Before I forgot to mention that not only are those sending the pictures sometimes prosecuted, but also the receivers. Possession of child porn because some guy or girl in you class sent you a picture. Yes, this has happened, you can google sexting and see this ridiculousness is true. | |

There is nothing illegal about consenting adults texting explicit images of each other, but it is different when young teens do it. I don't personally see them as sex offenders, but in the eyes of he criminal justice system they are taking/sending indecent photographs of children, even if it is photos of each other. Depending on their circumstances it could also be classed as 'inciting a child to perform a sexual act' or 'causing a child to watch a sexual act'. Although receiving the messages is not an offence, keeping them counts as 'possessing an indecent image'. Anyone who forwards the messages to others then commits another offence of 'distributing indecent images of children' but whether the police would initiate a prosecution where young people have acted consensually is another matter. There was a girl, I think from Ohio, who committed suicide. She had been taunted about photos she sent to her boyfriend, that were sent around school and ended up on facebook and myspace. | |

I have heard of many cases of minors being prosecuted for this. Even a case were a 12 year old girl was selling nude pictures of herself to adult men. I think that labeling them as sex offenders is extreme. That is something that sticks with someone forever and is disastrous to their future. It also takes away from the meaning of sex offender which usually make one think of rape and other more serious offenses. If there is a large influx of sex offenders for simply sending their own picture to a friend as a joke than down the line people are not going to think much of someone being labeled a sex offender and rapists will be ignored because people figure it was just for sexting. I believe an appropriate punishment for minors should be based on what they did. A girl sending pictures of her tits to a girlfriend as a joke should not even go to court. That should be referred to her parents and she should attend some sort of seminar about the possible consequences. Sending full nudes to another minor should only result in many hours community service. Sending a lot of nudes to a lot of minors or adults should result in a short stay at a juvenile facility and a good bit of counseling. But all of these should be sealed with there juvenile records and should in no way affect their adult lives. I girl, or guy, sending a friend a nudy picture should not be comparable to rape. Well all did dumb shit when we were minors and some of us still do dumb shit. An 18 year old girls is praised by us guys for sending nudes out, but a 17 year old is branded a sex offender? It simply is not right. I am not trying to defend kids sexting each other, it has obvious issues. I am sure if I was a father I would go ape shit if I found out my kid was doing that. But I would be absolutely devastated to see his or her future ruined because of what they thought was a little bit of stupid, but otherwise harmless fun. I don't think that these kids should be charged with a crime but I do believe they need some serious help. Sending nude pictures of yourself isn't remotely as bad as giving someone a BJ all the while thinking that it isn't sex. When exactly did society get so screwed up that these things happen? I'm in my 40's and although technology was not available to do some of these things. I'm pretty sure that most girls from my time would never have sent naked pictures of themselves. In some sense, I think it's just an evolution of sexual freedom. It surprises me how many young people I've heard who go to sex parties and talk about it like it's just another Saturday night on the town. I had my doubts they were telling the truth 'til some of them showed me pictures. They got a kick out the momentary look of disbelief on my face. That's probably part of it too - another generation trying to shock the old timers. Then again, with us sitting here on a porn forum, we're probably just as guilty. I'd have a hard time believing that my parents would have talked about porn let alone watched it. That said we are adults. I'm talking about kids. I remember listening to a talk show discussing those colored bracelet where each color represented a specific sexual act and if a boy was able to snap the appropriate bracelet from a girl then she was obligated to perform that act. That would not have happened in my time. I don't know if I'd call it evolution of sexual freedom as much a devolution. I'm saure that quite a few politicians would love to blam porn for what's happening but when you have a teenage Miley Cirus performing a pole dance on TV and not a single person including her parents comes out and says that this was outrageous. I was referring to kids too. I was just saying that kids today see sex as something more open than we do, just like our sexual morality isn't as rigid as our parents. Our ability to sit here on this forum proves it. Just like I think the world has evolved into something with their priorities all out of whack, I never meant to imply that evolution automatically meant something positive. I certainly don't agree with what a lot of what I've seen from the younger generation but, again, it's a form of evolution because they're rebelling against an established set of morals just like we did. The trouble is that when someone from your generation wanted someone to have a nude picture they took a Polaroid and that was the only copy. It could not get around as easily. Now everything is done digitally and can be copied to no end. Within seconds everyone in the state can have a copy. It lasts much longer and is so widely viewable. It just does not go away and people do not think of that before doing it. A teen who sexts his or herself to another teen is guilty of being a teen. Short of strong prescription drugs -- which I'm sure some pharmaceutical giant is already brewing in a lab -- I seriously doubt adults will ever figure out how to gets kids' minds off sex. No, I would be horrified if my son or daughter was sending out nude photos, bu then again I would be horrified if I had a son or daughter in the first place! :o Sorry, but it's just human nature, and even multiple cases of prosecutorial prudishness are not going to turn things around or even scare hot and horny teens enough to make them stop. Maybe the judges and prosecutors who waste time and taxpayers' money on this will eventually get around and pull their heads out of their asses in order to go after real criminals, but I don't have very high hopes at the moment. Just look at Wittyguy's original post in his excellent Free Speech and Porn thread. (I am surprised I was the only one to respond to that post, but then again I do like to anger up the blood.) No offense, but I think that when you make this statement it is when you declare that you are officially out of touch. :) Again, I am just joking here, as I think we all reach a point where we look around and go "Goddamn kids/country/society/culture/morals -- it's all gone to hell!" just not at the same point in our lives, and maybe not all at once. I am in college and I definitely have some issues with people even a few years younger than me, but it's not the sexting, which I have yet to find anyone actually doing anyway (but I am looking!). Sometimes it's political, like people who claim they "want their country back," or it's social, or religious, or something else, but it seems to mostly be generational. The more years between people's birth dates and the more different they seem to be in the way they choose to run their lives and look at the world. I don't look at as the collapse of society, or the screwing up of society, or anything like that. It's just the passage of time, and like it or not it's going to keep on marching. What I find interesting that it is legal for someone aged (UK) over 16 to have sex but if they're under 18 (ie 16-17) then they can't send pictures of themselves whilst they can have sex...strange but makes sense since you need to be over 18 to adult 'model' Personally I think cases should be judged on an individual basis and on the light of the evidence a suitable punishment made (never happens) | |

Speaking of Mom and Dad, they could do something about it: disable texting on the cell phones. It may sound harsh or "Draconian," though it's hardly as bad as 30 days in the stocks. Beats having to hire a lawyer for your stupid, pain-in-the-ass kid. I wanted something new, so I left England for New England. | |

God Forbid you prevent teenagers from texting. That would mean they'd have to actually speak face to face with another human being. It's amazing that in an era where communications is made easier. My oldest sister is a classic enabler. She and her husband adopted a baby when they were both in their late 30's, which made them older parents, relatively, and they were both horrible at establishing any control over her - and weren't big on anybody else establishing any control of her either. I remember being blown away once when my sister was complaining about the school taking away my niece's cell phone for repeatedly taking it out and using it during class. My sister's response? She can't help it - she has ADD. Actually, the problem is that she's a BRAT. I like the girl, she's my niece, but she's been terribly spoiled and needs to be left to her own devices to sink or swim to find out how to actually relate to other people in the world properly. I wouldn't be shocked at all to find out that my niece and her friends were doing that sexting thing when they were young. I remember when that movie Kids came out. I saw it and thought it was sensationalistic and not realistic at all. Then a friend of mine told me a story about his step-daughter and it was basically that movie played out for real - except with more consequences. | |

I agree with Drooler, disable the texting. It can be done, although it is a pain because you actually have to call the phone company to have it done. At least have it disable the Picture and Video abilities. Another thing that should be considered is to have all pictures and videos automatically sent to the parents. This might curb some of the kids from being stupid. On the other hand, now there is another copy of the illegal kitty porn floating about. Something needs to be done to make it disappear without ruining these kids' lives before they begin. Hey -- with only a difference in screen and keyboard size -- isn't that how we all communicate here? ;) I don't think texting is that bad...yet. Frankly I am much happier around strangers when they are only typing instead of squawking and gabbing into a phone in public. But I will admit that I am even happier when people can learn to have real conversations with actual words, complete sentences, and fully formed thoughts. Texting seems to too easily give people an excuse to just go "Ah fuck it, I'm done having normal face-to-face conversations." Texting really seems to make conversing a cheap thoughtless exercise, instead of a way to actually interact with other people on more than just a superficial level. It also seems to serve, like PinkPanther mentioned, as a way for people to get away with having abnormally short attention spans. Yes, I am sure some people really have ADD, but if everyone who has a cell phone has it...well, then we are all in trouble. It's going to be like that recent speech the president made to a joint session of Congree; a lot of representitaves and senators there were too busy texting to pay attention. Eventually all this sexting and texting and tweeting will just be routine, and then when we die, there's going to be some asshole at our funeral going "Hey, can we hurry this up?
