Does anyone know why the law allows a name to be trademarked?

As many of you know, the lovely and energetic Dakota Skye has had to change her name to Kota Skye due to the fact that a stripper somewhere in the U.S. also goes by Dakota Skye and had it trademarked. This also happened several years ago when Violet Blue had to change her name to Noname Jane because an online sex writer trademarked the name. It seems odd that the law allows this. I assume that it has to do with it being a stage name and that trademarking a proper name wouldn’t be allowed. If so, is anyone interested in crowd funding to trademark “Donald Trump”?

I’ll still catalogue Kota Skye’s scenes under “Dakota Skye” and regardless of what she changed her name to I’d continue to source, buy and download anything she’s in. And fuck Violet Blue the writer, I still list my ‘Noname Jane’ scenes under Violet Blue.

(As an aside, here in Canada a decade or so ago our ultra-right-wing party, the one now in power, proposed passing a law that had been floated by the right-wing of the Republican party that would allow more direct democracy. If a certain number of citizens petitioned the government for a change in the law Parliament had to at least debate it. At the time, one of the party’s leaders was a man named Stockwell Day and a popular political comedy show started a petition to require him to change his first name to Doris. Within hours it far exceeded the support needed and the party dropped the idea quickly. But then they went on to form the government, where they’ve been for almost a decade and are busily transforming the country…)

^My guess is that since most of the people who trademark their names tend to be celebrities of one kind or another and they expect to be able to earn money from that name then the last thing you want is for someone else to be able to appropriate it for their own profit.

Another reason why they might have to do that is that they are not trademarking their real name but their stage name. Unless they actually trademark their stage name then they can never go in front of a judge and say that is my name when in fact it isn't and never was.

The case of Dakota is a good example of a manager not doing his or her job. Her name should have been trademarked the moment she started to become popular. She had been doing porn for nearly two years when the issue came to a head. Mind you from some of what she wrote on ADT. She may have had ulterior reasons for going with a different name. it's quite possible that someone else(other than the stripper) owned the name Dakota Sky ie: Her manger or someone behind the scene. She is guaranteeing her future by changing her stage name and trademarking it. Long live the Brown Coats.

I would like to trademark the names of John Doe, Jane Doe, John Smith, and Jane Smith.

Think of all the money we could make, if we take to court any people with those names, and force them to pay us royalties for the right to continue using those names.

What a great idea. We could use crowd funding to support the copyright.

And we could force the police and other law enforcement organizations to pay us any time they use those names (or aliases) in their court papers.

Fantastic. I've found the way to pay for all our future porn subscriptions.

I didn't know this but need see the other day on a site it say Koda Skye and wondered why when I thought American porn stars tend to stick to one name. I prefer the name Dakota to be honest as got used to her been that.

I agree with you on the tattoo thing, but it isn't overly obtrusive. Still, it was unnecessary on such a perfect little body.

Intellectual property is like a trip to bizarro land or trying to get your head around quantum mechanics when the world you know is Newtonian based. I know you can't trademark a person's given birth name but if you name your kid "Coca Cola" don't expect them to be able to make money off their name or even be able to advertise their name; the legal bills would dwarf the college fund. Stage names can be trademarked as, I think, real names but only in conjunction with a marketable product or service. It only gets more complicated from there.
